Legal Policies and Terms

Jumpeople Corp, a corporation registered in Panama, Republic of Panama ("Jumpeople," "we," "us," or "our"), operates the digital platform jumpeople.com (the "Platform") from its main headquarters. Jumpeople provides talent management and job connection services through its digital platform and other authorized channels (the "Services"). Additionally, our international support is provided by our local affiliate companies ("the affiliate companies"). These affiliates strictly offer internal support to Jumpeople Corp but do not independently manage or operate the Platform or provide the Services directly. 

For inquiries regarding Jumpeople Corp, its Services, or the Platform (such as the use of job connection tools), as well as for sending or delivering documents, correspondence, notifications, or other related communications, please contact Jumpeople Corp directly through the official contact channels of its headquarters in Panama. 

Jumpeople Corp does not accept or recognize any legal domicile in offices or locations other than its official headquarters in Panama. Affiliate companies are not authorized to operate or act as legal agents on behalf of Jumpeople Corp and cannot process any procedures related to bookings, contracts, or operations beyond their role as internal support. 

Waiver of Jury Trial and Class Actions 

By accepting the general terms and conditions, the loyalty program terms and conditions, the Jumper Community terms and conditions, and/or the newsletter terms and conditions, you expressly waive your right to a jury trial and to participate in any class action, representative action, or collective proceeding related to claims arising from the use of our services. This means that disputes must be resolved through arbitration rather than in court. Likewise, multiple individuals may not join together to file a collective claim in an arbitration proceeding. 

Governing Law and Jurisdiction 

These terms are governed by the laws of the Republic of Panama. All disputes related to Jumpeople Corp's services will be resolved through confidential arbitration, following the procedures established by the Center for Conciliation and Arbitration of Panama (CeCAP), as set forth in our dispute resolution policies outlined below. 

 

Mandatory Arbitration for Dispute Resolution 

Any dispute or conflict related to the services provided by Jumpeople, the use of the website, or any other service or product provided by the company shall be resolved solely through binding arbitration instead of being taken to court. This arbitration will be confidential and conducted in the Republic of Panama under its current legal framework, except in cases where the dispute concerns intellectual property rights violations, which will be addressed through separate provisions agreed upon by the parties. 

Arbitration is the only available mechanism for dispute resolution, excluding the possibility of taking legal action through the courts, except in specific circumstances provided for under Panamanian law. 

Arbitration Procedure 

1. Prior Notification: Before initiating any arbitration proceedings, you must send Jumpeople a written notice detailing the nature of the dispute, the requested remedy, and the facts supporting your claim. This notice must be submitted via the contact section on our website. Please include your full name, email address, phone number, and a mailing address where we can reach you to amicably resolve your request. 

2. Resolution Period: Both parties (the user and Jumpeople) will have 30 business days from the notification of the dispute to resolve the issue through direct negotiation. If an agreement is not reached within this period, either party may initiate arbitration. 

3. Initiation of Arbitration: If negotiations fail, either party may initiate arbitration under the applicable Panamanian regulations. Jumpeople will cover the administrative costs of arbitration, excluding any expenses related to attorneys, experts, witnesses, or other defense or representation costs. 

4. Individualized Procedure: All arbitration proceedings will be conducted on an individual basis. Collective, representative, or similar arbitrations are not permitted. Each claim must be submitted and resolved separately without involving other potential claimants or consolidating claims into a single arbitration. 

 

Exclusion of Class Actions and Representative Procedures 

You and Jumpeople agree that any claim related to services will be resolved individually. Class actions, consolidated claims, or representative procedures are not allowed. Arbitration will be strictly individual, ensuring each dispute is handled separately. 

Any attempt to consolidate claims or join other claimants in similar disputes will not be applicable, reinforcing the individualized approach to conflict resolution. 

 

Enforcement of Arbitration Agreements and Jurisdiction 

This arbitration agreement is supported by Panamanian law, and the arbitrators administering the process will act under the legal and procedural framework of Panama. The jurisdiction for these proceedings will be determined by the arbitration terms, and any arbitration decision may be enforced in Panamanian courts. 

If arbitration provisions cannot be properly applied due to the nature of the claims, the parties must agree on an alternative mechanism in compliance with Panamanian law. 

 

Applicable Arbitration Rules and Regulations 

Arbitration will be governed by the arbitration rules issued by the Center for Conciliation and Arbitration of Panama (CeCAP), the designated body for managing the process within Panama. In some cases, the parties may agree on additional rules to better adapt to the type of dispute, always in compliance with local laws and internationally recognized procedures. 

 

Exception for Small Claims Court 

Despite the above provisions, both you and Jumpeople retain the right to file certain claims in a small claims court if the dispute's value does not exceed limits established under Panamanian law. However, this right is strictly limited to certain situations and does not include the possibility of participating in class actions. 

 

Notification and Dispute Resolution Prior to Arbitration 

Before formal arbitration begins, the parties must allow for dispute notification and resolution through an informal negotiation process, attempting to resolve the issue without immediate legal action. The Dispute Notice must be sent to Jumpeople’s contact address via certified mail to ensure formal receipt of the claim. 

If the dispute is not resolved within 60 days through this negotiation process, the affected party may initiate arbitration. 

 

Costs and Fees 

Jumpeople will cover the administrative costs of arbitration, excluding attorney fees or other legal representation costs. If the arbitration costs become prohibitively high for either party, the arbitrator may intervene to reduce costs and ensure the process remains reasonable. 

The arbitrator may also order the reimbursement of expenses incurred by either party, particularly if a claim is deemed frivolous or filed in bad faith. 

 

Arbitral Award 

Once arbitration is concluded, the arbitrator will issue an award resolving the claim, which may be enforced in Panamanian courts. The arbitral award is final, with very limited possibilities for review. The final decision must be based on applicable facts and laws, and the arbitrator will provide an explanation of the reasoning behind their decision.

Copyright Infringement Notifications 

If you believe that any content on our platform infringes your copyright, you may notify us in writing, providing the required details to our designated copyright agent. Below are the necessary steps and required information to take appropriate action: 

Required Information in Your Notice: (a) Your physical or electronic signature. (b) A clear description of the copyrighted work that you believe has been infringed. (c) Identification of the allegedly infringing content, along with sufficient information to locate it (such as a URL or screenshot indicating its exact location on our platform). (d) A direct contact method, such as a physical address, phone number, or email. (e) A good faith statement indicating that the content's use is not authorized by the copyright owner, their representative, or the law. (f) A declaration that the information provided is accurate and that you are authorized, under penalty of perjury, to act on behalf of the affected copyright owner.
